Terms of Service
1. Agreement to Terms
These Terms of Service (“Terms”) are a binding agreement between you and IFH Operations LLC, doing business as Ice Forge Hockey Training Center (“Ice Forge,” “we,” “us,” or “our”). They govern your use of www.iceforgehockey.com (the “Site”), the Ice Forge mobile or hosted booking interfaces, our physical training facility at 2925 Airway Ave, Suite A, Costa Mesa, CA 92626 (the “Facility”), and all training sessions, classes, programs, and other services we offer (collectively, the “Services”).
By accessing the Site, creating an account, booking a session, or entering the Facility, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
These Terms include important provisions on assumption of risk, waiver, limitations of liability, mandatory arbitration, and a class-action waiver. Please read them carefully.
2. Eligibility
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf, to use the Services. By using the Services, you represent that you meet this requirement.
Parents and legal guardians who book sessions for minors are responsible for the minor’s compliance with these Terms and for executing any liability waivers we require.
3. Accounts
Booking and managing your sessions requires a client account hosted by our third-party booking platform, Mindbody. By creating an account, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at IFHteam@iceforgehockey.com of any unauthorized use.
Mindbody’s own terms and privacy policy also govern your use of its platform.
4. Bookings, Payments, Cancellations, and Refunds
4.1 Booking
All bookings — including shooting bay rentals, coached sessions, camps, clinics, parties, and gym sessions — are made through Mindbody, by phone, or in person. A booking is confirmed only upon receipt of payment (or authorization to charge) through Mindbody.
4.2 Pricing
Posted prices are in U.S. dollars and do not include applicable taxes or fees. We may change prices at any time; the price applicable to your booking is the price displayed at checkout.
4.3 Cancellation and Late Arrival
Our cancellation and late-arrival policies are administered through Mindbody and may be updated from time to time. As of the Effective Date, the following terms apply unless otherwise stated at booking:
- Cancellations more than 24 hours before the scheduled session: full refund or credit at your option.
- Cancellations within 24 hours: forfeiture of the session fee, at our discretion.
- No-shows: full forfeiture.
- Arrivals more than 15 minutes late may forfeit the remainder of the session at the discretion of the coach or staff member.
4.4 Refunds
Refunds for cancellations that comply with Section 4.3 will be issued through Mindbody to the original payment method. Refunds for facility credits, packages, or non-refundable items are at our sole discretion.
4.5 Memberships and Recurring Charges
If you purchase a recurring membership or auto-renewing package, you authorize Mindbody to charge your payment method on the stated schedule until you cancel. Cancellation takes effect at the end of the then-current billing period and does not entitle you to a refund of fees already paid, except where required by law.
5. Facility Rules and Safety
By entering the Facility or participating in any Service, you agree to abide by the following rules. Ice Forge may refuse entry, cancel a session without refund, or remove a participant who violates these rules.
- Helmets required under age of 18 on all training surfaces.
- Shoes only on all shooting bays.
- No tape on hockey sticks.
- No food or beverage on training surfaces.
- Follow the directions of all Ice Forge staff and coaches at all times.
- Children must be supervised by a parent, guardian, or designated adult at all times.
- Personal property is your responsibility; Ice Forge is not liable for lost, damaged, or stolen items.
- No abusive, threatening, or unsafe behavior toward staff, coaches, or other clients.
Additional rules may be posted at the Facility or provided at orientation.
6. Assumption of Risk and Waiver
Hockey training involves substantial risks, including but not limited to: collision with pucks, sticks, equipment, walls, or other participants; falls and impacts with rebound boards or playing surfaces; injuries to the head, neck, back, joints, or extremities; cardiovascular events from strenuous activity; and exposure to communicable disease.
By participating in any Service, you acknowledge and accept these risks on behalf of yourself (and, for minors, on behalf of the minor participant). To the fullest extent permitted by California law, you release Ice Forge, its owners, officers, employees, contractors, coaches, and agents from any and all claims, demands, liabilities, costs, or expenses arising from injury, loss, or damage suffered while using the Services, except to the extent caused by Ice Forge’s gross negligence or willful misconduct.
This Section does not replace any separate written Liability Waiver that Ice Forge may require you to sign before participating; both apply.
7. Acceptable Use of the Site
You agree not to:
- Use the Site for any unlawful purpose or in any way that violates these Terms.
- Interfere with or disrupt the Site or its underlying networks.
- Scrape, crawl, or use automated means to access the Site, except for public-search-engine indexing.
- Attempt to gain unauthorized access to any portion of the Site, account, or system.
- Upload or transmit viruses, malware, or harmful code.
- Impersonate any person or misrepresent your affiliation.
- Use the Site or Services in a way that infringes the intellectual property or other rights of any third party.
8. Intellectual Property
The Site and its content — including text, images, graphics, video, the Ice Forge logo, the tagline “The Best Players Aren’t Just Born. They Are Forged.℠”, and all associated trademarks — are owned by Ice Forge or its licensors and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial viewing of the Site.
User-submitted content (e.g., reviews, testimonials, photos shared with us): by submitting content, you grant Ice Forge a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content for purposes related to the Services and to our marketing.
9. Third-Party Services and Links
The Site contains links to and embeds from third-party services, including Mindbody, Google, Meta, TikTok, Instagram, X, and YouTube. We do not control and are not responsible for the content, privacy practices, or terms of those third-party services. Your use of any third-party service is governed by that party’s own terms and policies.
10. Disclaimer of Warranties
The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, Ice Forge disclaims all warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no guarantees of specific athletic outcomes or performance gains from use of the Services.
11. Limitation of Liability
To the fullest extent permitted by law, Ice Forge and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangibles, arising out of or related to these Terms or your use of the Services, even if we have been advised of the possibility of such damages.
Our aggregate liability for any claim arising out of or related to these Terms or the Services will not exceed the greater of (a) the total amounts you paid to Ice Forge in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law (including, in California, gross negligence or willful misconduct).
12. Indemnification
You agree to defend, indemnify, and hold harmless Ice Forge and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) your conduct at the Facility.
13. Dispute Resolution; Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
13.1 Informal Resolution
Before filing any claim, you agree to attempt to resolve the dispute by contacting us at IFHteam@iceforgehockey.com and giving us 30 days to address it.
13.2 Binding Arbitration
Except as otherwise provided in Section 13.4, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by JAMS in Orange County, California, before a single arbitrator, in accordance with JAMS’s rules then in effect. Judgment on the award may be entered in any court of competent jurisdiction.
13.3 Class-Action Waiver
You and Ice Forge agree to bring disputes only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. No class arbitration is permitted, and the arbitrator may not consolidate more than one person’s claims.
13.4 Exceptions
Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in a court of competent jurisdiction to prevent infringement of intellectual property rights.
13.5 30-Day Opt-Out
You may opt out of Section 13.2 (Binding Arbitration) and Section 13.3 (Class-Action Waiver) by sending written notice to IFH Operations LLC (DBA Ice Forge Hockey Training Center), Attn: Legal, 2925 Airway Ave, Suite A, Costa Mesa, CA 92626 within 30 days of first accepting these Terms. Your notice must state your name, address, account email, and a clear statement that you wish to opt out. Opting out does not affect any other provision of these Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 13, any action that may be brought in court must be filed in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
15. Changes to Terms
We may modify these Terms from time to time. The “Last Updated” date at the top will reflect the latest version. Material changes will be communicated by email or a prominent notice on the Site. Your continued use of the Services after a change becomes effective constitutes acceptance of the revised Terms.
16. Termination
We may suspend or terminate your account or access to the Services at any time, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 6, 8, 10, 11, 12, 13, and 14) will survive.
17. Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy and any signed Liability Waiver, constitute the entire agreement between you and Ice Forge regarding the Services.
- Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notices by email, SMS, or posting on the Site. You may send notices to us at the address in Section 18.
- Force Majeure. We are not liable for delays or failures arising from events outside our reasonable control (e.g., natural disasters, labor disputes, utility outages, pandemic, government action).
